JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2018 Petitioners apprehend their arrest in connection with Danapur P.S.Case No. 546 of 2014 registered for the offences punishable under Sections 302, 109, 120B, 386 and 387 of the Indian Penal Code.

Allegation against the petitioners is that due to negligence and not properly medical care the father of the informant died.

Submission of learned counsel for the petitioners is that FIR itself shows that operation was successful and thereafter he was shifted to High Tech hospital for medical care and father of informant, who was 80 years old, died and there is no negligence

Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Danapur, in connection with Danapur P.S.Case No. 546 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
