Petitioners are apprehending arrest in connection with Supaul River P.S. Case No. 07 of 2017 for an offence under sections 147, 148, 149, 341, 323, 324, 307, 337, 379, 504 and 506 of the Indian Penal Code.

Counsel for the petitioners submits that there is specific allegation of assault against co-accused Rabindra Mukhia and Ram Sevak Mukhia. He submits that there is no allegation of

Patna High Court Cr.Misc. No.53793 of 2017 (2) dt.15-11-2017 2/2 assault against these petitioners. He also submits that petitioners have no criminal antecedent.

Considering the fact that there is no allegation of any overt act against these petitioners and they have clean antecedent as per statement made in para-3, let the petitioners, named above, be released on bail in the event of arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul, in connection with Supaul River P.S. Case No. 7 of 2017, subject to the condition as laid down under section 438(2) of the Cr.P.C.
