The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 34 of the Indian Penal Code.
The prosecution case as per F.I.R is that all the F.I.R named accused persons including petitioners, variously armed entered into the house of the informant and assaulted the informant and his wife. It is
Patna High Court CR. MISC. No.28512 of 2022(2) dt.02-11-2022 2/3 specifically alleged against Chandeshwar Sahani that he assaulted with bhala to the informant, as a resulf ow which, the informant sustained injuries.
It is submitted by learned counsel for the petitioners petitioners have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. The specific accusation of making assault is against Chandeshwar Sahani who is not petitioner before this Court. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.
In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IVth, West, Muzaffarpur in connection with
