====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 14-12-2020 Due to COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding.

The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case for the offence registered under Sections 147, 148, 149, 307, 302 and 326 of the I.P.C.

The prosecution story, in brief, is that on 11.06.2017 at about 9.45 A.M., the husband of the informant, namely, Ram Chandra Singh, who was the brother of this petitioner, stated to him to spare some land for use in passage and then construct his

No.28157 of 2020(3) dt.14-12-2020 2/3 house, upon which, this petitioner and his wife Veena Singh and three sons brought Bhala, Daab and Gadasi and started assaulting the husband of the informant and her son. The specific allegation against this petitioner and his son Tuntun Singh is that they assaulted with Bhala to the husband of the informant and her son Guddu Kumar Singh due to which, her husband Ram Chandra Singh died and her son Guddu Kumar Singh sustained grievous injury. The reason behind the occurrence is previous land dispute.

Earlier bail applications of the petitioner were rejected by the then Co-ordinate Benches of this Court vide Cr. Misc. No. 56865 of 2017 under order dated 18.01.2018, Cr. Misc. No. 35183 of 2018 under order dated 18.07.2018 and Cr. Misc. No. 13376 of 2019 under order dated 28.05.2019 taking into account that the petitioner is the main assailant and he had given Bhala blow upon the deceased which led to death of the deceased. This is fourth attempt on behalf of the petitioner for grant of bail.

A report was called for from the learned court below regarding the present stage of the case. It has been reported that four prosecution witnesses have been examined and the trial is expected to be concluded within a period of six months..

Patna High Court CR. MISC. No.28157 of 2020(3) dt.14-12-2020 3/3 Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Sessions Trial No. 840/2018, arising out of Parsa P.S. Case No. 97/2017, pending in the court of learned Additional Sessions Judge-XII, Saran at Chapra.
