JUSTICE BIRENDRA KUMAR ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406/420 of the Indian Penal Code.

Co-accused Ujjawal Kumar, Secretary of an N.G.O. known as Ashram Foundation, was initially provided with Cheque of Rs.4,10,000/- for imparting computer training to the students of the referred schools. Thereafter, Ujjawal obtained certificate of completion of training from different Headmasters including the petitioner and was paid the remaining amount of Rs.4,10,000/-. Later on, on some oral complaint regarding embezzlement, the F.I.R. was lodged.

Submission of the petitioner is that co-accused

Patna High Court Cr.Misc. No.51942 of 2016 (3) dt.28-01-2017 2/2 Ujjawal Kumar had already been allowed anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 31819 of 2014 on 21.01.2015.

Considering the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Vishal Kumar, J.M., 1st Class, Sheohar/Successor Court in connection with Piprahi Police Station Case No.71 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
