JUSTICE ANIL KUMAR SINHA ORAL ORDER 13-08-2019 The petitioner apprehends his arrest in connection with Harnaut P. S. Case No. 38 of 2019 registered under Sections 307,323,341 and 379/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is that he fired upon the father of the informant, which hit the hand and stomach of his father causing firearm injury.

Learned counsel appearing on behalf of the petitioner submits that there is no specific allegation against the petitioner and he has falsely been implicated in this case. On the other hand, learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that petitioner is named in the FIR. He further, relying upon paragraph-7 of the case diary, submits that statement of the

No.27977 of 2019(3) dt.13-08-2019 2/2 victim has been recorded by the police, who has supported the version of the FIR in which there is specific allegation against the petitioner of firing upon the father of the informant. After having heard learned counsel for the parties and taking into consideration the fact that victim has received bullet injury fired by the petitioner in his stomach, as such I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail to the petitioner is rejected.
