JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Khagaul P.S. Case No. 238 of 2019 for the offence under Section 366(A) read with Section 34 of the Indian Penal Code. Prayer for bail was earlier rejected by a Bench of this Court vide order dated 25.02.2020 passed in Cr. Misc. No. 7317 of 2020 with liberty to the petitioner to renew his prayer for bail after framing of charge.

Having regard to the nature of the allegations against the petitioner, the Court is not inclined to grant any indulgence to him. The application is rejected.

However, the court below is directed to expedite the

No.24870 of 2020(3) dt.23-11-2020 2/2 trial and conclude the same at the earliest preferably within a period of six months from the date of receipt/production of a copy of this order failing which the court below shall release the petitioner on bail on appropriate terms and conditions. The court below is under obligation to furnish reasons for not following the observation made by this Court vide order dated 25.02.2020 passed in Cr. Misc. No. 7317 of 2020 before Registrar (Vigilance) of this Court.

Let a copy of this order be communicated to the Registrar (Vigilance) of this Court on administrative sides for appropriate action.
