Mr. Nivedita Nirvikar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 30-11-2022 Let the defect(s), if any, be removed within two weeks from today.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with C.B.I. Case No. RC 11(S) of 2016 lodged under Sections 120B, 302, 34 of the I.P.C. read with Section 27 of the Arms Act. Learned counsel for the petitioner submits that this case has been earlier rejected 4 times, report has been called for. From the report dated 30.09.2022, it transpires that out of 96 witnesses only 37 witnesses have been produced and Trial Court seeks minimum 6 months period to conclude the trial of this case.
Patna High Court CR. MISC. No.28466 of 2022(5) dt.30-11-2022 2/2 Learned counsel for C.B.I. opposes prayer for bail and submits that paragraph-3 indicates that there are in total 25 criminal cases pending against the present petitioner including the present one and seeks at least 9 months time so that the trial may be concluded.
The Trial Court is directed to expedite the trial on day to day basis.
In this view of the matter, I am not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected but liberty is hereby granted to the petitioner that he may renew his prayer for bail after 8 months from today.
With this observation, the bail application stands rejected.
