JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-03-2017 Heard the learned counsel for the petitioner as well as the learned counsel for the Informant. .
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 264 of 2007 for the offences punishable under sections 307, 379, 341, 363, 323, 342 and 504/34 of the I.P.C.
The allegation against the petitioner is that in the occurrence the petitioner snatched Titan wrist watch from the hand of the informant and thereafter all the miscreants fled away due to the protest made by the villagers of Mai.
Submission is of false implication and that now good sense has prevailed between the parties and the informant has filed
Patna High Court Cr.Misc. No.40204 of 2016 (5) dt.07-03-2017 2/2 compromise petition duly signed by all the parties in the court of the Chief Judicial Magistrate, Munger and as such the petitioner deserves sympathetic consideration.
The learned counsel for the Informant fairly submits that the matter has been compromised.
In the facts and circumstances as stated above, the petitioner, in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. S.D.J.M. Munger in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
