====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Chhapra Town (Nagar) P.S. Case No. 650 of 2018 instituted for the offence under Section(s) 413 and 414 of Indian Penal Code. It is alleged in the written report that Police apprehended two persons who were trying to run away on seeing the police party. They disclosed their names as Niraj Kumar @ Vikash Kumar and Deepak Kumar (petitioner). On search, Mobile phones and Glamour Motorcycle without number plate have been recovered from their possession. On demand, they could not produce paper of the aforesaid Motorcycle.

Counsel for the petitioner submits that petitioner is

Patna High Court CR. MISC. No.26992 of 2019(2) dt.26-04-2019 2/2 in custody since 27.10.2018 having clean antecedent. He further submits that petitioner has been implicated in the instant case merely on suspicion.

Keeping in view the period spent by the petitioner in custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra, in connection with Chhapra Town (Nagar) P.S. Case No. 650 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
