2. The petitioner is in custody in connection with Kuchaikote P.S. Case No. 480 of 2020 registered for the offence punishable under Sections 414, 420, 467, 468, 471 and 34 of the Indian Penal Code and section 20/22, 25/25 and 29 of the N.D.P.S. Act, lodged on 13.12.2020 by the informant Ashwini Kumar Tiwari.
3. As per the prosecution story, the informant alleged that on secret information, reached at N.H.-28 Balathari Check Post and thereafter started checking the vehicle and in course thereof intercepted a Truck bearing Registration Number NL01N-6608. Two accused persons tried to escape from the truck but were apprehended, who disclosed their name Mushtaque (petitioner herein) and Aftab Alam. On search, two
Patna High Court CR. MISC. No.30781 of 2025(5) dt.12-09-2025 2/2 quintal 'ganja' was recovered/seized. Accordingly, the F.I.R. was lodged and the accused were taken into custody.
4. Pursuant to the last order, learned APP Mr. Jitendra Kumar Singh has filed affidavit on behalf of the Deputy Superintendent of Police, Headquarter Gopalganj according to which all the prosecution witnesses have been examined and the trial is at conclusion stage.
5. Considering the aforesaid facts and the trial is already at the final stage, no relief can be extended to the petitioner.
6. The bail application stands rejected.
