The petitioner apprehends his arrest in a case registered for the offences punishable under Section 341, 323, 324, 379, 307 & 504/34 of the Indian Penal Code. On demanding her saree by wife of the informant from wife of Dinesh Singh which was flown away on her terrace she started slating her and both the Dinesh Singh and his wife intruded into her house armed with lathi and knife and petitioner assaulted on the neck of his wife by means of knife and when the informant rushed in his rescue he also gave knife blow to him but he escaped the assault then petitioner assaulted on his head by means of lathi.

Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. The petitioner is

Patna High Court CR. MISC. No.27535 of 2019(3) dt.30-07-2019 2/2 quite innocent and has been falsely implicated in this case. There is case and counter case between the parties. There is no allegation of slating the informant and his wife against the petitioner. The petitioner is said to have given knife blow on the neck of the wife of the informant but the doctor has found the neck injury lacerated and simple in nature. Petitioner has no criminal antecedent.

Learned APP for the State opposed the bail petition.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabhua in connection with Bhabhua (Sonhan) P.S. Case No. 76 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
