JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-07-2018 The petitioners seek bail in anticipation of their arrest in connection with Morkahi P.S. Case No. 86 of 2017 dated 16.06.2017 instituted for the offences under Sections 147, 148, 149, 323, 341, 379, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Because of the land dispute, the occurrence is alleged to have taken place.

It has been alleged in the F.I.R that the accused persons including the petitioners, variously armed, came to reap the standing crops of the informant and on protest, firing was resorted to. The miscreants are alleged to have taken away the grains, causing losses of around Rs. 75,000/-

No.32850 of 2018 (2) dt.04-07-2018 2/2 Regard being had to the fact that there is a land dispute between the parties and similarly situated co-accused persons have been granted anticipatory bail by a Bench of this Court, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Khagaria in connection with Morkahi P.S. Case No. 86 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
