JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-09-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Sikroul P.S. Case No. 42 of 2016, disclosing offences under Sections 409 and 353/34 of the Indian Penal Code. The petitioner is Panchayat Secretary of Belhari Panchyat in Buxar district. It is alleged against him that he did not furnish to the Vigilance team, registers/folders relating to appointment of Panchayat Teachers for the Employment Years 2003-2005-2006. The Vigilance team is enquiring into the alleged forge committed in course of such appointments. Learned counsel appearing on behalf of the petitioner has submitted that charge of the said documents were not handed over to him after he joined as Panchayat Secretary of the said

Patna High Court Cr.Misc. No.40654 of 2016 (2) dt.23-09-2016 2/2 Panchayat on 05.10.2014 and, therefore, he could not make available to the Vigilance team the concerned document. Considering the nature of the allegation against the petitioner, this application is allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Buxar in connection with Sikraul P.S. Case No. 42 of 2016, corresponding to G.R. No. 1552 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
