The petitioner apprehends his arrest in Chiraiya P.S. case No.27 of 2015 under Section 420, 467, 468 of the Indian Penal Code and under Section 13 of Prevention of Corruption Act. The informant filed complaint case in the year 2014 on the basis of which the present FIR was lodged. The informant alleged that he worked under a scheme by the order of Kiran Devi, Mukhiya and the then Panchayat Rojgar Sevak, Vinod Das in the year 2011 but after completion no payment was made. The learned counsel for the petitioner submits that petitioner is Project Officer and he was posted in the aforesaid Panchayat in the year 2015 itself. The work was done during the

Patna High Court Cr.Misc. No.771 of 2017 (2) dt.13-01-2017 2/2 period 2011-13. The petitioner was not posted during the relevant period from 2011-13.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, East Champaran at Motihari in Chiraiya P.S. Case No. 27 of 2015, G.R. No. 265 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
