2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Salmari P.S. Case No. 102 of 2024 registered for the offence under Sections 308(5), 111(1) of the B.N.S. Act.

3. According to the case of prosecution, on 20.12.2024 the informant Adarsh Agrawala made a written complaint before the concerned Police Station alleging their in that on 18.12.2024 one named accused Shankar Yadav called him on his mobile and demanded Rs. 50,00,000/- as ransom on the basis of said FIR has been registered. During course of investigation on 20.12.2024 police party reached the house of Shankar Yadav there present applicant and

Patna High Court CR. MISC. No.27096 of 2025(2) dt.06-05-2025 2/3 some other accused persons were arrested. It is alleged that present applicant is also involved in the alleged crime.

4. Learned counsel for the petitioner submits that the present applicant is not named accused, he has implicated in this case only on the basis of his confessional statement, which is not admissible in evidence. Apart from that there is no other evidence available on record. He is in custody since 21.12.2024 therefore, it is prayed that he may be granted benefit of bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

6. Considering the above submissions made by the learned counsel for the petitioner and further considering the fact that the apart form the confessional statement, there is no any other evidence available on records against the present applicant. I am of the view that the petitioner should be enlarged on bail.

7. Accordingly, the application is allowed.

8. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction
