JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-05-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek pre-arrest bail in connection with Marhowrah P.S. Case No.93 of 2018 registered under Section304 (B) of I.P.C.

The accusation is of killing daughter of the informant by her husband and other in-laws due to non-fulfillment of demand of motorcycle in dowry and disposing of her dead body. Learned counsel for the petitioners submits that petitioners no.1 and 2 are brothers -in-law, petitioners no.3 and 4 are Gotanies whereas petitioner no.5 is the mother-in-law of the deceased. In fact, on 2.3.2018 all the petitioners were engaged in

Patna High Court Cr.Misc. No.28827 of 2018 (2) dt.09-05-2018 2/2 Holi festival. In the meantime, quarrel took place between deceased, Nisha Kumari and her husband, Sujit Giri due to which Nisha Kumari committed suicide. Thereafter her funeral was performed in presence of her father. As such, the petitioners have been falsely implicated in this case.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Saran at Chapra, in Marhowrah P.S. Case No.93 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
