JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-307, 302, 353, 120(B) & other minor sections of the Indian Penal Code.

Petitioners and some others were arrested by the police in connection with a murder case and while petitioners were being taken by the police, they raised alarm, which attracted the villagers, who attacked on police party but anyhow, the situation was taken under control by the police party by resorting fire. However, one constable was killed in the aforesaid occurrence by the villagers and his dead body was recovered later on. Submission on behalf of the petitioners is that

No.47290 of 2016 (2) dt.16-12-2016 2/2 according to prosecution case itself, at the time of alleged occurrence, petitioners were in custody of the police and moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail by a coordinate bench of this court.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Bodh-gaya P.S. Case No. 68 of 2013 to the satisfaction of learned Chief Judicial Magistrate, Gaya. (Hemant Kumar Srivastava, J) A.K.V./- U T
