2. The petitioners in this case are seeking pre-arrest bail in connection with Barahat P.S. Case No. 171 of 2023 registered for the offences punishable under Sections 420, 467, 468, 385, 387, 34 of the Indian Penal Code. The petitioner no. 1 has got three criminal antecedents whereas petitioner no. 2 has got one criminal antecedent.

3. As per the prosecution story, the informant had purchased a piece of land bearing Khata No. 654, Khesra No. 4586, 3588 and Rakba No. 161 decimal. But these petitioners have forcibly occupied the said piece of land on the basis of forged document. It is alleged that the informant is not even able

Patna High Court CR. MISC. No.30785 of 2024(3) dt.06-06-2024 2/3 to do farming due to these petitioners. It is further alleged that the petitioners are demanding Rs. Ten Lakh as extortion.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case due to land dispute.

5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioners.

6. Having regard to the materials on the record which have been duly discussed in the order of learned Additional District and Sessions Judge, 1st Banka and on noticing the allegation that the petitioners have allegedly forcibly occupied the land of the informant on the basis of a document which has been found forged and fabricated in course of inquiry by the Circle Officer, they are indulged in demanding Rs. Ten Lakhs from the informant for releasing the land, petitioner no. 1 has got three criminal antecedents whereas petitioner no. 2 has got one criminal antecedent and that the case has been found true in course of investigation against the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.

7. The prayer is refused.

8. In case, the petitioners surrender and pray for regular bail in the learned court below within a period of four
