====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-05-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Mehsi P.S. Case No.24 of 2016 registered under Sections 420, 409 and 353/34 of the Indian Penal Code. The accusation is that the petitioner being the Secretary of Gram Panchayat-Kaswa Mehsi was asked to submit file folders regarding the appointment of Panchayat Teachers within the stipulated time but the same was not furnished by the petitioner, as required in the inquiry about illegal appointment of the Panchayat Teachers.

Learned counsel for the petitioner submits that, admittedly, the petitioner was the Panchayat Secretary to Gram

Patna High Court Cr.Misc. No.28929 of 2018(2) dt.09-05-2018 2/2 Panchayat-Kaswa Mehsi, District-East Champaran at Motihari. While he could not submit the required file folders regarding the appointment of Panchayat Teachers in time but, later on, he submitted the same on 6.08.2016, which would appear from Annexure- '2' series to this application and the same has also been detailed in the impugned order.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Motihari, East Champaran, in connection with Mehsi P.S. Case No.24 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
