====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 13-12-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Teghra P.S. Case No. 385 of 2020, registered under Sections 392 & 397 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 06.02.2021, and is a person of clean antecedent and charge-sheet has been submitted, allegation as alleged in the F.I.R. is that the informant alleges that he is a government servant and when he was returning home from his Block Office, Bachhwara and when he reached near Gaura Chaur Bhawara, he was surrounded by three unknown persons on a motorcycle and they looted at gunpoint his Pulsar motorcycle, mobile phone, cash of Rs. 1,800/-

Patna High Court CR. MISC. No.37904 of 2021(2) dt.13-12-2021 2/3 alongwith a blanket and a bag containing owner book, pan card Aadhar Card, residential certificate, income certificate etc were looted. Learned counsel submits that petitioner is not named in the F.I.R. and his name transpires from the confessional statement of co-accused Suraj Kumar from whom the mobile was recovered and further, the mobile which was recovered from the petitioner is not tallied with the I.M.E.I. number of stolen mobile.

Learned APP for the State opposes the prayer of regular bail application of the petitioner.

Considering the fact that the petitioner is in custody since 06.02.2021, charge-sheet has been submitted in this case and the petitioner, is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Teghra P.S. Case No. 385 of 2020, with a condition that till charges are not framed petitioner will mark his attendance before the concerned police station in between 20-25 and in the event it is reported by the concerned P.S. to the learned Court below that the petitioner in between aforesaid date not marked his attendance in any of the

Patna High Court CR. MISC. No.37904 of 2021(2) dt.13-12-2021 3/3 month till framing of the charge, the Court below will at liberty to cancel his bail bond.
