The petitioner seeks bail in connection with Madhubani Town P.S. Case No. 78 of 2017 instituted for the offence under Section(s) 366(A)/34 of the Indian Penal Code. It is alleged in the written report that petitioner who is son-in-law of the informant had kidnapped the daughter of the informant while he had gone for her treatment with his son-inlaw, namely, Md. Haider to Sadar Hospital, Madhubani. Learned counsel for petitioner submits that the victim, on recovery, has stated that she has voluntarily gone with this petitioner to Delhi and stayed with him for several days.The victim has been medically examined and the doctor has found her age to be 20 years.
Patna High Court CR. MISC. No.31078 of 2019(2) dt.09-05-2019 2/2 Learned counsel for petitioner submits that the victim has later on married with this petitioner and a compromise petition has also been filed in the Court below which has been annexed as Annexure-5 to bail petition.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S. Case No. 78 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.
