Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Petitioner who happens to be driver of pickup van bearing Registration No.WB 04 W 9029 was carrying wine totaling 1608 bottle royal stag each containing 375 ml, royal stag 348 bottle each containing 750 ml, 48 bottle, imperial blue each containing 750 ml, imperial blue 48 bottle each containing 375 ml, 132 bottle each contain 750 ml and on interrogation, he disclosed that he was transporting the same on an order of Ashok Kr. Jha, Debar of registered owner Sharmila Jha. Chotu @ Vikash Kumar and Mahesh Paswan happens to be owners of the aforesaid articles who were following. It has further been disclosed that seeing the police, they after leaving their motorcycle succeeded in their escape. It is apparent that petitioner happens to be under custody since 30.07.2016 and from para-3 it is evident that petitioner has got no criminal antecedent.
Patna High Court Cr.Misc. No.49164 of 2016 (2) dt.15-12-2016 Considering the status of the petitioner, petitioner Jay Ram Jha is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, Samastipur in connection with Rosera P.S.
