The petitioners seek pre-arrest bail in connection with K.Hat(Sahayak) P.S. Case No.113 of 2018 registered for the offences under Sections 341, 323, 324, 307, 447, 504, 506 and 34 of I.P.C.
Accusation is that on 27.2.2018 at 2.P.M. the petitioners after encroaching the land of the informant, Sukati Devi started construction work and attempted to cut her mango tree. When she made protest all started to abused her and assaulted her. In course of mar pit the petitioner no.3 Suresh Sharma gave garasa blow on her and petitioner no.1 Bablu Das and Vijay Das caught hold of the hands of the informant.
Patna High Court Cr.Misc. No.28823 of 2018 (2) dt.09-05-2018 2/2 Learned counsel appearing on behalf of the petitioners submits that due to land dispute occurrence of mar pit took place in which petitioners' side also sustained injuries regarding which petitioner no.3 has instituted K.Hat (Sahayak) P.S.Case No.114 of 2018 on 28.02.2018 for the offences under Sections 341, 323, 448, 427, 324, 504, 506 and 34 of the I.P.C. All the injuries found on the person of the informant are simple in nature. The petitioners have got no criminal antecedent.
Having considered the facts and the circumstances of the case, let the petitioners above named, in the event of their arrest or surrender before the court below within six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Purnea, in K.Hat(Sahayak) P.S. Case No.113 of 2018 subject to the conditions as laid down under Section 438(2) Cr.P.C.
