The petitioner apprehends her arrest in Phulwarisharif P.S. Case No. 258/2016, registered for the offences punishable under Sections 406, 420, 504 and 506 of the Indian Penal Code and Section 3 of B.P.F.D. Act.

The informant named the petitioner along with other accused persons and alleged that petitioner was Cashier of private bank Basil International Ltd., Exhibition Road, Hari Naryan Complex, Room No. -201 Patna and the informant deposited money in the bank, but in the month of December, 2014, the bank was closed and money was not returned to the informant and other investors.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.41311 of 2016 (3) dt.21-12-2016 2/2 informant alleged that petitioner was working as Cashier of the bank, but in fact, petitioner was Account Assistant. Petitioner was not at all concerned with the business of the bank and petitioner never persuaded the informant or any other investor to invest in the bank. Petitioner was an employee and she has not defalcated any amount of the investors of the bank.

Considering the facts aforesaid, the petitioner abovenamed, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Patna in connection with Phulwarisharif P.S. Case No. 258/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
