JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-11-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, being the brother-in-law (Bahnoi) of the husband of the victim, is apprehending his arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after three years of the marriage for non-fulfillment of dowry demand of motorcycle and she-buffalo. It is submitted by learned counsel for the petitioner that on conclusion of investigation police submitted final form and the petitioner was not sent up for trial vide Final

Patna High Court Cr.Misc. No.51913 of 2017 (2) dt.10-11-2017 2/2 Form No. 07/17 dated 31.01.2017 but differing with the final form the cognizance has been taken against the petitioner also. The petitioner claims to be residing at different place. The petitioner was married prior to the marriage of the victim and thrust of accusation is against the husband of the victim. Considering that the thrust of accusation is against the husband of the victim and that the police, on conclusion of investigation, finding the accusation untrue against the petitioner, submitted final form, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 231 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
