Petitioner seeks bail in a case registered for the offences punishable under Section 304 of I.P.C. Allegation against the petitioner is that he is not a qualified Doctor and was running Maa Durga Clinic where a patient died during course of treatment.

Learned counsel for the petitioner submits that the patient had voluntarily come to Maa Durga Clinic where the petitioner is not a Doctor rather he is running the establishment and some other Doctor has treated the patient, i.e. the husband of the informant. Petitioner is in custody since 08.03.2020. Considering the period already undergone by the petitioner for his negligence as well as completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand)

Patna High Court CR. MISC. No.28098 of 2020(3) dt.25-01-2021 2/2 with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Saharsa Sadar Police Station Case No.221 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall file affidavit before the learned court below that he has already closed Maa Durga Clinic for which the petitioner has neither licence of a Pharmacist or a Druggist nor a licence for running a Nursing Home. (d) If the learned court below would come to the notice that in spite of the aforesaid affidavit, the petitioner has violated the terms by running the aforesaid clinic by whatever name may be in unauthorized manner, that would be a ground for cancellation of bail in this case also.
