The petitioner apprehends his arrest in connection with Nayagoan P.S. Case No. 15 of 2019 registered under Section 30(a) of the Bihar Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. He further submits that on perusal of Seizure List, it is apparent that nothing has been recovered from the possession of the petitioner rather 45 litres of IMFL was recovered from the orchard. It is also submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

No.27650 of 2019(2) dt.26-04-2019 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Excise, Begusarai in connection with Nayagoan P.S. Case No. 15 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) shailendra/- U T
