The petitioner apprehends his arrest in Excise Case No.66C3 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The police on secret information went to Gopalpur Middle School and found two persons standing near the latrine room but they managed to flee away. On suspicion, the police searched the latrine of the school and recovered 451.35 litres of foreign liquors of different brands.
Learned counsel for the petitioner submits that the police on mere suspicion named the petitioner in the present case as well as in two other cases being Gogri P.S. Case No.65 of 2020 and Gogri P.S. Case No.67 of 2020. The petitioner has

Save and except suspicion, nobody has seen the petitioner keeping the foreign liquor in the latrine of the school. Even the Investigating Officer did not disclose the facts from whom the so-called eye witnesses knew about the name of the petitioner. Taking into consideration the facts aforesaid, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Excise Case No.66C3 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
