This application is for grant of regular bail in connection with Sasaram (Mufassil) P.S.Case No.509 of 2018for the offences under Sections 30(a), 34, 38 of the Bihar Prohibition and Excise Act, 2016..
Prosecution story is that the police on information that the accused persons are manufacturing liquor raided the place and seeing the police the accused persons fled away. It is the Chowkidar who has disclosed the name of those persons including that of the petitioner and further there is recovery of country-made liquor from there.
Submission of the learned counsel for the
Patna High Court CR. MISC. No.25838 of 2019(3) dt.25-06-2019 2/2 petitioners is that they have falsely been implicated in this case at the instance of the Chowkidar.
Heard learned A.P.P. also.
Having heard both sides and in view of the fact that the petitioners are named by the local Chowkidar and they are named in the FIR also, I am not inclined to grant bail to the petitioner, however, let the petitioners surrender before the learned court court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day.
