JUSTICE PARTHA SARTHY ORAL ORDER 13-11-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video-conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Maker P.S. Case No. 62 of 2020 registered under sections 411 and 414 of the Indian Penal Code.

As per allegation in the F.I.R, a stolen motorcycle was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that he had purchased the said motorcycle and it appears that he was duped. It is further submitted that he has no criminal antecedent and is in custody since 2.6.2020.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the fact that F.I.R has been registered under sections 411 and 414 of the Indian Penal Code where the sentence may only be a fine together with the fact that

Patna High Court CR. MISC. No.28238 of 2020(2) dt.13-11-2020 2/2 investigation in the case has been concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Maker P.S. Case No. 62 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned In-charge ACJM XII, Saran at Chapra.
