This application for anticipatory bail arises out of Bhagwanpur P.S. Case No. 155 of 2018, disclosing offences under Sections 147, 148, 447, 504, 506, 341, 323, 324, 354 and 379 of the Indian Penal Code.
For an occurrence said to have taken place on 28.08.2018, the FIR came to be registered on 04.09.2018, for which there is no explanation. Allegedly, the informant's son was assaulted by the co-accused Raju Bhagat and the petitioner is said to have attempted to outrage the informant's modesty. There is allegation that the persons named in the FIR, under certain conspiracy, had entered into the house of the informant. The reason of the occurrence has, however, not been given in

Considering the facts and circumstances, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned ACJM-III, Vaishali, Hajipur, in connection with Bhagwanpur P.S. Case No. 155 of 2018, subject to the condition as laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
