Mr. Addl Public Prosecutor ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-10-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State through Video conferencing.

Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147/148/307 and other allied sections of the Indian Penal Code. Prosecution's case in short is that the petitioners along with 20 other co-accused persons named in the FIR and 10 to 20 unknown persons armed with lathi, danda, axe, etc damaged the Government vehicles. They also tried to snatch arms from the police party.

Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.24639 of 2020(2) dt.08-10-2020 2/2 that the petitioners are innocent and have falsely been implicated in this case due to enmity with the Chaukidar. No case under section 307 IPC is made out. Allegation is general and omnibus and not specific against the petitioners. Petitioners have got no criminal antecedent.

Considering the facts of the case, prayer for bail of the petitioners is allowed. In the event of arrest/surrender, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Patepur Police Station Case No. 56 of 2020, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
