This is a petition for grant of anticipatory bail for offence under Section 420/34 of the Indian Penal Code.
In fact, there is relationship of the land lord and tenant between the parties. It has been informed by the parties that they have settled their dispute amicably. Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on provisional anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 2458(C) of 2009 to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, or successor Court, subject to the condition laid down under
Patna High Court Cr.Misc. No.41520 of 2016 (5) dt.02-03-2017 2/2 Section 438(2) of the Criminal Procedure Code. The provisional anticipatory bail shall be confirmed by the learned Court below on compliance of the commitment by the petitioner, as per the agreement between the parties.
