Quashing/setting aside the office order no.69 dated-01.04.2026 as contained in memo no.1629 dated-01.04.2026 issued by the office of the Executive Engineer, Public Health Division, Samastipur by which
Patna High Court CWJC No.7191 of 2026(2) dt.07-05-2026 2/3 the petitioner has been debarred from taking part in any next tender/bid offered by the respondents due to not making payment of electricity bill, which is said to be due till date, whereas the electric bill has already been paid by the petitioner and the same is already intimated to the authorities concerned and the issue is settled despite that the order of debarment is not recalled/rescind til date in a wrong, arbitrary and whimsical manner.
II. Be pleased to direct the respondents to make payment of amount of O&M of the aforesaid work which is completed on 01-09-2025 successfully by the petitioner with no complaint till final completion of stipulated period but the due amount is not being paid to the petitioner in a very wrong and illegal manner. III. And be pleased to rectify the electricity bill which is wrongly calculated and huge amount of penalty is added in the electricity bill which is causing harassment to the petitioner including financial loss. IV. And/or be pleased to pass such other order/orders which may be deemed fit and proper in the facts and circumstances of the case and allow the petitioner to take part in any open tender without any hindrance."
2. At the outset, the learned counsel for the respondents, Shri. Vikash Kumar (SC 11) submits that the order of debarment dated 01.04.2026 passed by the Executive Engineer, Public Health Division, Samastipur is only limited to the present agreement in question, arising out of Agreement No. F2-20/2019-20 and the petitioner is not disentitled to participate in any other tender.

In view of the aforesaid stand taken by the learned counsel for the respondents, the learned counsel for the petitioner submits that his grievances stands substantially redressed, however he be granted liberty to approach the respondents for payment of his legally admissible outstanding. Liberty, so sought, is granted.
4. Accordingly, present writ petition stands disposed of.
