Petitioner seeks bail in a case registered for the offences punishable under Sections 364(A) of the Indian Penal Code and later on Sections 302/201 I.P.C. was added. The FIR of the occurrence of kidnapping and murder is against the holder of Mobile No.8298295093. Submission is that the petitioner is not holder of that mobile. Name of the petitioner surfaced in the confessional statement of co-accused-Santosh Kumar @ Santosh Kumar Singh. Santosh Kumar @ Santosh Kumar Singh has already been allowed bail by a Coordinate Bench of this Court in Cr. Misc. No. 29841 of 2019. Petitioner is in custody since 09.11.2018. Learned counsel for the informant opposed the prayer for bail.
However, considering the fact that there is no substantial material against the petitioner to refuse prayer for bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Shiv Sagar Police Station Case No.361 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
