The petitioner seeks bail in connection with Mahua P.S. Case No. 29 of 2020 for the offence under Sections 399 and 402 of the Indian Penal Code and Section 25(1-B), a, 26, 35 of the Arms Act.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has falsely been implicated in this case merely on the basis of suspicion. The petitioner is rotting in judicial custody since 22.01.2020.

Patna High Court CR. MISC. No.24965 of 2020(4) dt.15-12-2020 2/2 Learned A.P.P. for the State has opposed the prayer for bail and submitted that the petitioner is having criminal antecedent of same nature of case.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection Mahua P.S. Case No. 29 of 2020.
