ANJANA MISHRA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Pratapganj P.S. Case No. 15 of 2015 for the offences registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.
Learned counsel for the petitioner submits that though the allegation has been made against the petitioner, no advantage has accrued to the petitioner as he was neither appointed nor joined. It is further submitted that similarly situated co-accused persons have been extended the privilege of anticipatory bail by this court vide order dated 05.05.2016 passed in Cr. Misc. No. 17889 of 2016
Patna High Court Cr.Misc. No.39146 of 2016 (3) dt.15-11-2016 Considering the aforesaid facts and circumstances of the case and that the similarly situated co-accused persons have been extended the privilege of anticipatory bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Birpur, District - Supaul in connection with Pratapganj P.S. Case No. 15 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
