The petitioner apprehends his arrest in Ramgarhwa P.S. Case No.257 of 2018 registered under Sections 292, 293, 294, 306, 376, 511, 354, 354(A), 406, 509 and 34 of the Indian Penal Code and under Sections 43(A), 66, 67(B) of the I.T. Act. The father of the victim made, in sum and substance, allegation that the petitioner being brother of a friend of his daughter came in contact with his daughter but later on the petitioner with some ulterior motive took selfie of the daughter of informant. The petitioner started blackmailing the daughter of the informant and called her in a hotel where the petitioner made an abortive attempt to outrage her modesty but somehow the daughter of informant saved herself and fled away. Learned counsel for the petitioner submits that the first occurrence is said to have taken place in the year 2017. All the allegations made against the petitioner are false and concocted. The case-diary was called for but nothing has come. It is further submitted that it is true that the petitioner was having talked with the victim but the petitioner never made any attempt to blackmail the victim. It appears from perusal of F.I.R. itself that on account of intimacy the petitioner started blackmailing her and also made an abortive attempt to outrage her modesty. Being subjected to all sorts of mental torture on account of such blackmailing by the petitioner, the victim also made an abortive attempt to do away with her life. Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
