Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Ramgarh (Nuaon) P.S. Case No. 103 of 2020, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 325, 307, 447, 504 and 506 of the Indian Penal Code and section 27/30 of the Arms Act. As per the prosecution case, 07 named and 04 to 05 unknown persons variously armed came at the Dalan of the informant and began to abuse. On protest by the informant, all the accused persons surrounded the informant and on the order

No.28400 of 2020(2) dt.10-11-2020 2/2 of Ram Bachan Bind, co-accused Shivnarayan Bind, Dinesh Bind and this petitioner opened fire by their fire arms on the informant which hit his Panjara causing injury to him. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to land dispute. There is general and omnibus allegation. Petitioner is in custody since 22.05.2020 having no criminal antecedent. Learned APP however, vehemently opposed the prayer for bail and submitted that this petitioner is alleged to have fired from his single barrel gun upon the informant, as a result of which he sustained grievous injury. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
