Petitioner has filed present writ application for a direction to the respondents to change the date of birth of the petitioner in the record of the C.B.S.E.
Mr. Vinay Krishna Tripathy, learned counsel appearing on behalf of C.B.S.E. has drawn the attention of this Court to Annexure-6 which indicate that C.B.S.E. in order to
Patna High Court CWJC No.9254 of 2019(3) dt.26-07-2019 2/2 examine the merit of the application for correction in the date of birth of the petitioner solicited information from Sri Ramkrishna Vidhya Mandir, Gandhi Nikunj, Rannychak Makandpur, Bhagalpur, the erstwhile school wherefrom he has done his initial school and the previous school has intimated the C.B.S.E. that the claim of the petitioner for charge of date of birth is misconceived and contrary to the entry made in the record of the school.
Considering the report of the erstwhile school contained in Annexure-6, the Court does not find any merit in the writ application. However, liberty shall be available to the petitioner to file suit before appropriate Civil Court for declaration of his date of birth.
With the aforesaid, the present writ application stands disposed of.
