The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273 and 34 of the Indian Penal Code and section 30(a) of Bihar Prohibition and Excise Act, 2016.

As per allegations in the F.I.R., on a raid being conducted, 402.1 litres of IMFL was recovered from the house of the petitioner. Besides the petitioner, her husband and other accused persons were taken into custody.

It is submitted by learned counsel for the petitioner that she has been falsely implicated in the case. She is a newly married housewife who is herself in the family way. She has no concern with the seized articles. She is in custody since

Patna High Court CR. MISC. No.38143 of 2021(2) dt.11-08-2021 2/2 29.3.2021 and has no criminal antecedent. Investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the petitioner being in the family way together with the investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Minapur P.S. Case no.114 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
