This application for grant of anticipatory bail arises out of Rajpur P.S. Case No. 140 of 2016, disclosing offences under Sections 406, 409, 420 and 120B of the Indian Penal Code. The petitioner is Panchayat Secretary of Harpur Gram Panchayat in the district of Buxar. It is alleged against him that he did not make available to the Vigilance Investigation Bureau the registers, folders and other documents relating to appointments made to the post of Panchayat Teachers in the said Panchayat. The Vigilance Investigation Bureau is investigating into the fraudulent appointments made to the said post.

Learned counsel appearing on behalf of the petitioner has submitted that much before he had joined as Panchayt Secretary, those appointments were made and after his joining, he

Considering the submissions as above, this application is allowed.

Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-7, Buxar in connection with Rajpur P.S. Case No. 140 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
