====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 26-06-2018 Heard Sri Nikhil Kumar Agwaral , learned counsel for the petitioners and Sri Pramod Kumar Pandey, learned Additional Public Prosecutor.
Two petitioners, apprehending their arrest in connection with G.O. Case No. 15 of 2018 arising out of Ghanshyampur P.S. Case No. 01 of 2018 , registered for the offence under Sections 272/273 of the Indian Penal Code, 1860 and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender primarily on the ground that petitioners are having clean antecedent and in this case save and except suspicion there is no material. It has also been argued that in the case
Patna High Court Cr.Misc. No.31887 of 2018(3) dt.26-06-2018 2/2 though some quantity of foreign liquor was shown to be recovered from an Auto, petitioners were not having any connection with the said Auto. Only it was alleged that petitioners were one of the associates of the owner of the said Auto.
Be that as it may, considering the nature of accusation as well as clean antecedent of petitioners, in the event of their arrest or surrender within a period of six weeks from today, let petitioners Md. Laddan and Nodul Jakil @ Bauka @ Md. Bauka be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate , Darbhanga / concerned court in connection with Ghanshyampur P.S. Case No. 01 of 2018 [ G.O. Case No. 15 of 2018 ] subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
