The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 354(A), 354(B) and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner no. 1 is said to have caught the daughter of the informant and tried to misbehave with her. Petitioner no. 2 is alleged to have thrown bricks from the roof.

It is submitted that the present case is counter blast of Sakra PS Case No. 114 of 2020 which was instituted by

Patna High Court CR. MISC. No.28968 of 2022(2) dt.26-09-2022 2/2 petitioner no. 2 against the informant and others. Both parties are agnates. Injury report does not support the prosecution case. Petitioners have got clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Muzaffarpur in connection with Sakra P.S. Case No. 172 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
