The petitioners seek bail in anticipation of their arrest in connection with Paharpur P.S. Case No. 291 of 2017 dated 14.10.2017 instituted for the offences under Sections 341, 323, 324, 307, 379, 504, 34 of the Indian Penal Code.

A scuffle took place over a plot in question at the time of construction of a house. Petitioner no. 1 is said to have assaulted the husband of the informant by means of tangi which led to injuries on his legs. Other accused persons including the petitioners are alleged to have taken part in the affray.

Learned counsel for the petitioners has

Patna High Court Cr.Misc. No.30312 of 2018(3) dt.28-06-2018 2/2 submitted that a totally false case has been instituted against them. There is a counter version of the occurrence as well and the injuries suffered by the husband of the informant are simple in nature. Considering the background facts, the petitioners above named are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Paharpur P.S. Case No. 291 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
