JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Risup P.S. Case No. 38 of 2017, registered under Sections 341, 342, 323, 324, 354, 379, 308 and 504/34 of the Indian Penal Code.

The accusation is that in the morning of 06.06.2017, informant, Sunita Devi, was filling the drain, which was constructed, after Panchayati, then her brother-in-law Promod Mehta, sister-in-law Lalita Devi (petitioner) and Sarpanch brotherin-law Manoj Mehta came there and caught hold. At that time, Promod Mehta caused injury at her head through iron rod whereas Manoj Mehta pulled her Sari and tried to outrage her modesty. In the meantime, petitioner snatched her gold chain.

Patna High Court Cr.Misc. No.57751 of 2017 (2) dt.18-12-2017 Learned counsel for the petitioner submits that scuffle took place due to land dispute, in which, petitioner's side also sustained injury, regarding which, Risup P.S. Case No. 37 of 2017 is also instituted on the basis of written report of the petitioner. Further submission is that petitioner being the lady has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VIII, Aurangabad, in connection with Risup P.S. Case No. 38 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
