Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Kasma PS case no. 82 of 2018 instituted for the offences punishable under Sections 406, 420 of the Indian Penal Code. 3.

As per the allegation made in the First Information Report, petitioner being the Ward Member of Ward No. 9 of Chev Panchayat of District- Aurangabad, withdrew a sum of Rs. 2,40,000/- from the Bank, fraudulently by putting the signature of Secretary of the Managing Committee namely Bidhi Chandra Paswan.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on the basis of the concocted story. The money was withdrawn by the Secretary

Patna High Court CR. MISC. No.31693 of 2024(2) dt.02-08-2024 2/2 of Managing Committee and the work of the Scheme has been completed in the concerned Ward. Learned counsel further submits that the signature upon the cheque has not been compared with the signatures of the petitioner and the said Bidhi Chandra Paswan. The petitioner is stated to be in custody since 04.01.2024.

Regard being had to the submissions made by learned counsel for the parties and taking into consideration the fact that the petitioner is in custody for about 07 months and there is no likelihood of tampering of the evidence, I am inclined to grant regular bail to the petitioner. 6.

This application is, accordingly, allowed.

Let petitioner, abovenamed, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Kasma PS case no. 82 of 2018.
