The petitioner apprehends his arrest in connection with Kachhawan P.S. Case no. 42 of 2016, registered under Sections 406, 420, 120(B) of the Indian Penal Code. The accusation is that petitioner took Rs. 2,60,000/- to the informant Ranjan Kumar Singh for providing the job in Police department, but in spite of much persuasion appointment letter was not handed over to the informant by this petitioner and on repeated requests, the petitioner did not return the said amount.

Learned counsel for the petitioner submits that, in fact, informant of the present case has taken money to Rajiv

No.31298 of 2018(2) dt.12-06-2018 2/2 Kumar Singh, brother-in-law of the petitioner and on repeated requests Prince Kumar, brother-in-law of the informant handed over a cheque of Rs. Five Lakhs, but the same was dishonoured regarding which Rajiv Kumar Singh, brother-in-law of the petitioner has lodged Kachhawan P.S. Case No. 38 of 2016, under Sections 406 and 420 of the I.P.C. and Section 138 N.I. Act on 08.10.2016 against the informant and others and due to that reasons, the present case has been lodged with false allegation. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in connection with Kachhawan P.S. Case No. 42 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
