JUSTICE SATYAVRAT VERMA ORAL ORDER 25-11-2022 Heard learned counsel for the petitioners and learned Spl.P.P. for the Vigilance through the virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 409, 420, 467, 468, 471, 477(A), 120(B)/34 of the Indian Penal Code and Sections 13(2), 13(1)c, 13(1)d of the Prevention of Corruption Act, 1988.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and are relying on an order dated 13.09.2022 in Cr. Misc. No. 38944 of 2022 to submit that the case of the petitioners is on a better footing then

No.33155 of 2022(2) dt.25-11-2022 2/2 the case of Amar Bhushan, who was granted anticipatory bail by the aforesaid order as Amar Bhushan was the D.P.O., who had reinstated the petitioner in service with back wages by interpreting the order of this Court as recorded in the order dated 13.09.2022 in Cr. Misc. No. 38944 of 2022. Learned Spl. P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioners. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.

10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Special Vigilance Case No. 22 of 2021 (Bhagalpur) arising out of Supaul P.S. Case No. 800 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
